1. About Parking Haus
Parking Haus ("we," "us") operates a marketplace platform that connects drivers seeking parking with property owners ("Hosts") who rent out private parking spaces. We do not own, operate, lease, or control any parking spaces, vehicles, or property listed on the platform.
2. Driver waiver and bookings
When you book parking through Parking Haus, the full waiver shown at booking time governs your relationship with us, including the strict no-refund policy. For reference, the current waiver text is:
By booking a parking spot through Parking Haus, you ("Driver") acknowledge and agree:
1. Parking Haus is a marketplace platform that connects drivers with private property owners ("Hosts") who rent out private parking. Parking Haus does not own, operate, lease, or control any parking spaces, vehicles, or property.
2. The Host (not Parking Haus) is solely responsible for the safety, condition, accessibility, and security of the parking spot. Parking Haus makes no representations or warranties about any Host's property.
3. Driver parks at their own risk. Driver assumes all risk of loss, theft, vandalism, fire, collision, damage to vehicle or contents, personal injury, or property damage occurring while on or near the Host's property.
4. To the maximum extent permitted by law, Driver releases and waives all claims against Parking Haus, its affiliates, officers, employees, and agents arising from or related to (a) the parking spot, (b) the Host's property or conduct, (c) interactions with other drivers, hosts, or third parties, or (d) any event or activity at the venue.
5. Bookings are FINAL. No refunds are issued for cancellations, no-shows, late arrivals, or dissatisfaction with the spot. This policy keeps spot availability honest and protects hosts.
6. Driver agrees to obey all applicable laws and the Host's reasonable instructions while on the property. Driver agrees not to use the spot for any purpose other than temporary vehicle parking.
7. Disputes between Driver and Host must be resolved directly. Parking Haus may, at its discretion, mediate but is not obligated to do so.
8. This waiver is governed by Florida law and constitutes a binding agreement.3. Host responsibilities
Hosts are independent operators of their own property. They are solely responsible for: keeping the parking spot safe and accessible during the booking window; complying with local zoning, HOA, and insurance requirements; and accurately representing capacity and access details on their listing. Hosts agree that bookings made through the platform are binding obligations to honor — repeated cancellations or no-shows by a host may result in account suspension.
4. Payments and fees
All payments are processed by Stripe. Drivers pay upfront when booking. Of each booking amount, 80% is transferred to the Host's connected Stripe account and 20% is retained by Parking Haus as a platform fee. Stripe's standard processing fees apply on top. Hosts receive a 1099-K from Stripe for tax reporting.
5. Disputes
Disputes between Drivers and Hosts must be resolved directly. Parking Haus may, at our sole discretion, mediate. Any dispute between you and Parking Haus is governed by Florida law and must be brought in the state or federal courts located in Miami-Dade County, Florida.
6. Account termination
We may suspend or terminate any account at our discretion for fraud, abuse, repeated complaints, or violation of these Terms. Active bookings will be honored where possible.
7. Changes
We may update these Terms. Material changes will be communicated via email and posted here with a new "Last updated" date. Continued use after the change constitutes acceptance.
